TERMS OF SERVICE

Effective Date: January 1, 2026  |  Last Updated: March 2026
These Terms of Service govern your use of TheEmporiumAgency.com and any engagement with The Emporium Agency's consulting services. By accessing our website or entering into a service engagement, you agree to these terms. Please read them carefully.

1. About The Emporium Agency

The Emporium Agency LLC ("TEA," "we," "our," or "us") is a boutique consultancy providing cybersecurity consulting, social media management and automation, and digital brand protection services to individuals, self-proprietors, and small-to-medium businesses.

TEA is authorized by its governance charter to negotiate contracts, deploy specialized resources, and execute strategies in alignment with its stated mission of democratizing enterprise-grade consulting for SMBs and individuals.

2. Website Use

You may use TheEmporiumAgency.com for lawful purposes only. You agree not to:

  • Use the site in any way that violates applicable law or regulation
  • Transmit unsolicited commercial communications or spam
  • Attempt to gain unauthorized access to any part of our systems or infrastructure
  • Scrape, harvest, or systematically collect content or data from the site
  • Use the site to transmit malware or any harmful code
  • Impersonate TEA or any of its personnel

TEA reserves the right to terminate access to the site for any user who violates these terms.

3. Service Engagements

Consulting services — including cybersecurity, social media management, and digital brand protection — are governed by individual service agreements executed between TEA and each client. In the event of conflict between these Terms of Service and a signed service agreement, the service agreement controls.

Nature of Services

TEA provides advisory and consulting services. Our recommendations are informed by professional analysis of your specific situation, but outcomes depend on a variety of factors including client implementation, third-party platforms, and evolving threat environments. TEA does not guarantee specific outcomes from any advisory engagement.

Confidentiality

TEA maintains strict confidentiality regarding all client engagements, information, and business details shared during the course of our work. We do not disclose client identities or engagement details without express written consent, except as required by law.

4. Intellectual Property

All content on TheEmporiumAgency.com — including text, design, logos, graphics, and service frameworks — is the intellectual property of The Emporium Agency LLC and is protected by applicable copyright and trademark law.

You may not reproduce, distribute, modify, or create derivative works from any TEA content without prior written permission. Deliverables produced under a signed client engagement are governed by the intellectual property provisions of the applicable service agreement.

5. Cybersecurity Advisory Disclaimer

Our cybersecurity consulting services are designed to identify vulnerabilities, improve security posture, and reduce risk. However, no security measure is absolute, and TEA cannot guarantee that a client's systems will be immune from all threats following our engagement. Clients are responsible for implementing recommended controls and maintaining ongoing security hygiene.

TEA does not engage in offensive security activities, unauthorized access testing, or any activity that would constitute unlawful access to third-party systems.

6. Social Media & Brand Services Disclaimer

Social media management and brand protection services are subject to the terms, policies, and technical limitations of the platforms on which they operate. TEA operates within the permitted use policies of all social platforms. Results from content strategy and automation services depend on platform algorithms, audience characteristics, and market conditions outside of TEA's control.

Brand protection and IP monitoring services identify and report on potential infringement or impersonation. Enforcement actions, takedowns, and legal remedies are the responsibility of the client, typically in consultation with legal counsel. TEA does not provide legal advice.

7. Limitation of Liability

To the maximum extent permitted by applicable law, TEA shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our website or services. TEA's total liability arising from any service engagement shall not exceed the total fees paid by the client for the specific engagement giving rise to the claim in the twelve months preceding the claim.

8. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the United States and the state in which TEA is registered. Any disputes arising under these terms shall be resolved through binding arbitration or in the courts of competent jurisdiction, as agreed in the applicable service agreement.

9. Changes to These Terms

We may update these Terms of Service from time to time. Material changes will be communicated to active clients. Continued use of our website or services following notice of changes constitutes acceptance. The effective date at the top of this page indicates the most recent revision.
